Storage Tank Regulatory Bodies
At the State level, fuel facilities are governed by up to three departments:

PA
Deparment of Environmental Protection (PADEP)
The PADEP enforces PA Chapter 245, also called the storage tank regulations and its primarily focus is on protection of the environment. The PADEP hosts an online application that allows you to search its Storage Tank Database. -
PA Department of Labor & Industry, F&C Division (L&I)
L & I's Flammable & Combustible Liquids Division is responsible for the enforcement of Title 37, Part I, Subpart B., Chap's 11,12 & 13. These regulations cover protection to human safety. The authority of these regulations is under the State Police Fire Marshall, the enforcement is Dept. of L&I. These regulations reference NFPA 30 & 30A and NEC as well as some unique State mandated provisions. -
PA Department of Agriculture, Weights & Measures division
(W&M)
The PA Dept. of Weights and Measures authority and regulations come from Title 3, Part VI, Chap 41 and are only applicable in PA if you are selling fuel to the public in a metered amount.

IBC 2009 with State Amendments
In 2006 PA adopted IBC as the building code standards Statewide. Enforcement is at the local municipal level. There are exceptions to this, so always check with the local municipality. The current code set that is used State wide is IBC 2009. There are discrepancies between IFC and L&I's regulations, and both regulatory bodies claim jurisdiction. Again it is recommended that you check with the local jurisdiction when a potential conflict may arise. - Local Fire Marshall
Most local municipalities recognize L&I as the governing body for the enforcement and permitting of storage tanks. The two exceptions to this are the City of Philadelphia and the City of Pittsburgh as well as a few neighboring municipalities.
